Brim Graphic LLC:
Referred to as “Brim Graphic,” “We,” “Us,” or “Our.”
Chapter/Set:
A chapter is a piece of an arc within an action-adventure hybrid novel. A set is a collection of episodes within a magical romance hybrid novel.
Arc/Standalone:
An arc is one book within an action-adventure series. A standalone is a single magical romance book not meant to be a series.
Hybrid Novel:
A book format that combines comic panels and text to tell a story.
Brim Graphic Site/Site/Platform:
Refers to www.brimgraphic.com
Reviewer List:
An email list to receive reviewer copies of stories on our site in exchange for honest reviews.
Branded Story/Branded Contract:
Refers to hybrid novels and manga shorts officially owned, branded, and sold as Brim Graphic content.
Member/Creator:
Members mean people who have access to our website and stories featured. A creator is someone who posts their original works on our site for monetization.
Disclaimer Statement/Rewrite Request:
A statement made at the beginning of each chapter or set, expressing all work is strictly fictional and made for entertainment purposes. When a chapter or set is considered inappropriate a request to rewrite said chapter or set is made.
2. TERM CHANGES
We may at any time amend this agreement by publishing amended versions on Brim Graphic Site. You accept we have provided you with sufficient notice of the amendment. Although we will do our best to notify you of major changes, you should periodically review the most up to-date version of the agreement on our site.
3. CREATOR AND BRIM GRAPHIC AUTHORITY
Creators own the copyrights and contents of their work, along with control of distribution, unless it’s contracted as a branded story. However, if a creator owned work (Or a specific chapter or set) features content overly controversial; we reserve the right to remove such content from our site, unless a rewrite request is agreed upon. To avoid this, we require all creators to add disclaimer statements to their story folders.
4. CONTROVERSIAL SUBJECT MATTER
Our motto is to escape and be entertained. This motto refers to our quest to get back to good old fashion storytelling. Brim Graphic does not wish to post work aiming to preach at readers or excite negativity.
A. As stated in clause three, creators presenting such work will be hit with a rewrite request. If the rewrite request is denied; that specific chapter or set containing content disproved by Brim Graphic will be removed from our site.
B. Because of our dedication to create an environment solely based on enjoyment of stories as entertainment, we extend the right to decide which piece of content is negative and controversial.
5. BRIM GRAPHIC SITE USE ELIGIBILITY
You may use the site only if you are thirteen (13) years or older and capable of forming a binding contract with us and are not barred from using this site under any applicable law. As long as you comply with these terms, you may view and use our site for your personal, non-commercial purposes. No other use of this site is authorized.
6. INTERNATIONAL MEMBERS
Our site is controlled, operated, and administered from our office in Chicago Illinois, United States of America. We make no promises that content on our site is appropriate or available for use in other locations outside the United States. Content is prohibited from territories where the content or products available on this site are illegal. You may not use this site or export its content or products in violation of United States export laws and regulations. If you access our site from a location outside of the United States, you are responsible for compliance with all local laws.
7. GOVERNING LAW
These terms and any actions or proceedings related will be governed by the laws of the state of Illinois. If any provisions or part-provisions of these terms are declared invalid, unlawful, void, or for any reason unenforceable, it will be deemed severable and will not affect the validity and enforceability of the remaining provisions of these terms, which will be enforced to the maximum extent permissible.
8. MEMBER ACCOUNTS
You may be required to create an account with our site in order to access subscriptions, products, or services. We may refuse to grant you the username you request if said username is inappropriate. Your username and password are for your personal use only. If you use our site, you are responsible for maintaining the confidentiality of your account and password, as well as restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. In addition to all other rights available to Brim Graphic, LLC–including those set forth in these terms, we reserve the right to terminate your account or your use of this site, along with preventing future access to our site. We may also refuse service to you or subscriptions, if you violate any of these terms, for any reason or no reason. Upon such termination, your right to use our site will immediately cease.
9. CONTRACT TYPES
We provide two types of contracts for creators. Below summarizes the purpose of each contract.
A. Branded Contract:
This contract signs over ownership from creator to Brim Graphic, LLC. The creator still receives credit for work and an agreed upon monthly royalty from sales of all e-books, paperbacks, audiobooks, and merchandise.
B. Creator Contract:
This contract is a baseline contract for creator owned works. As well as an outline of expected monthly sales for the agreed upon time period. Creator Contacts show all copyrights and ownership is held by the writer/creator. However, the expected conditions to follow our zero tolerance of overly controversial subjects’ policy still stands.
10. PLATFORM FEE
Brim Graphic is a chapter e-book platform. There’s a 20% platform fee on sales of chapters and sets. This fee helps maintain our site. It pays for marketing, collaborators, site maintenance, and freelancers.
11. LOW ENGAGEMENT TERMINATION
Due to the limitations of our small platform, creator owned stories with low engagement or quality potentially face being removal from our site. We will not leave dormant/incomplete work on our site. Creators will be given a warning. A removal does not have to be permanent. Nor does this removal prevent us from accepting another story by same creator. This only applies for creators without a time clause in place. Creators with time clause must finish out their contract regardless of low engagement. However, low engagement can prevent time clause renewal. (As of right now, this clause will not be strictly enforced.)
12. HYBRID NOVEL DILEMMA
The hybrid novel is a rare format. Because of current publishing trends, comic panels and plain text never cross paths on major publishing platform. This is due to books with text and illustrations being classified strictly as novels, regardless of the book being inspired by comic or manga culture. We took this into consideration and created a list of places you can place your hybrid novel; in case your work is removed from our site for any reasons outlined within these terms. The list of platforms to use: Tapas, Wattpad, TheNinth.Art, Amazon, and Voyce.Me.
13. EMAIL ETIQUTTE
Brim Graphic, LLC uses one email for all inquiries: staff@brimgraphic.com. Because this email is being used for multiple tasks, we ask for all members, writers, artists, and etc. to clearly state the subject of their inquiry, so that the message is relayed to the correct staff member. Keep in mind, if your request is not clearly stated, we reserve the right to skip over said email in cases of high volumes of emails.
14. FULL PRIVACY POLICY
This privacy policy reviews all personal information we collect, use, and share as you visit, review, and purchase from www.brimgraphic.com.
A. Analytics:
If you visit our boutique, we track: Products you’ve viewed, which is used to save recently viewed products and suggest similar products. Location, IP address, and browser type: used for estimating taxes, shipping, and product display. We also use this to screen for potential risks and fraud. More generally we use this to improve and optimize Brim Graphic Site. (For example: by generating analytics about customer browsing behavior, we can determine how to market that product.)
B. Contact Form:
Contact forms collect only the data you type into each field. This information is sent to a Brim Graphic email only. The information may however be shared with our particular email service.
C. Future Merchandise Purchases:
When purchasing from Brim Graphic’s Boutique, we’ll ask for a name, billing address, shipping address, email address, phone number, and credit card/payment details. This information is for multiple purposes such as:

⦁ Calculating shipping prices.
⦁ Responding to requests, refunds and complaints.
⦁ Processing payments and prevent fraud.
⦁ Setting up accounts for our store.

D. Member Data Sharing:
Members may be checked through an automated spam detection service. Member subscriptions, when chosen will be shared with the chosen payment option. Examples of payment options are Visa, Mastercard, PayPal, Shop Pay, Meta Pay, Apple Pay, G Pay and etc.
E. Personnel Authorization:
The Site Manager is authorized to view all data from members in relation to improving and organizing our site. As well as, assisting our members.
F. Data Retainment:
For customers registered to our site, we store the personal information provided in your profile. All customers can see, edit, or delete their personal information at any time. The website manager can also see and edit that information. If you create an account, we will store whatever you type: name, address, email, and phone number. This will be used to populate the checkout for future orders. This information will be stored for as long as we need for the purposes for which we collect and use it. This includes both commercial and legal requirements. For example, we will store order information for tax and accounting purposes. This includes your name, email, billing, and shipping address.
G. Your Data Rights:
If you have an account on our site or have left reviews, you can request to receive an exported file of the personal data we hold about you, this includes any data you have provided to us. You can also request we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
15. COOKIE INFO
If you leave a review on our site, you opt-in to saving your name, email address, etc. in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another review. These cookies will last for one year. If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me” , your login will persist for two weeks. If you log out of your account, the login cookies will be removed. Cookies are also used for keeping track of cart contents while you browse our site.
16. DISTRIBUTION
As stated previously all distribution control is in the hands of each creator on our platform. Meaning you are not obligated to only have your work placed within our boutique. However, if you plan on having your work posted on other platforms, where purchasing is not required. You run the risk of not making a lot of sales within our boutique. That is why we suggest posting work on other payment platforms such as Amazon. For branded stories, we control distribution due to our ownership over the work in question.
17. THIRD PARTY DATA SHARE
Brim Graphic plans to use the third-party service Printify for its merchandise creation. Printify is a print-on-demand company. Working with a print on demand company allows us to save money on warehouse storage, packaging, and shipping. This means Printify will have access to your data through our future boutique. We recommend you reading their private policy (http://www.printify.com/private-policy/) and terms of service (http://printify.com/terms-of-service/)
18. CONTENT DISCLAIMER
Escape. Be Entertained: This is the motto Brim Graphic is operating on. Our content is meant to transport you to another realm of possibility. We’re aiming to be a platform for you to find fun, adventure, love, excitement, action, mystery, happiness, and most of all magic. Our content is not to be taken seriously. Everything is strictly meant for entertainment purposes and the joy of reading. Lastly, our action-adventure collection is for a more mature audience. Works within this collection will involve explicit language, images, and subjects. We don’t recommend anyone under 15 years old reading our action-adventures without the permission of a guardian(s) or a parent(s). We are not responsible for monitoring the content your children consume on this site.
19. REVIEWER LIST/REVIEWERS
If you’re looking to read stories for free, sign up for our reviewer list. Tell us which story you’re interested in reviewing. Keep in mind, when you become a part of our reviewer list you are required to leave reviews on the chosen story’s overview page. You are also required to post your review on your main blog or social media account. Please provide proof of each of your reviews placed on your blog or social media account. We also ask that all reviewers keep our OVERLY CONTROVERSIAL SUBJECT clause in mind when writing reviews.
20. PRICE GUARANTEE
Brim Graphic guarantees all subscription prices are to be locked within the $.99-$2.99 price range. To compete with other online publishing platforms who offer free to read content, we encourage you to join our reviewer list for free reviewer copies of chapters and sets.
21. ADVERTISING
